You are correct it is probably copyright protected but there has been no infringement in this thread since there was a link posted to the material. The material is readily available on the internet for those who have the knowlage to search for it. Walleye2go did not type or reprint the content of the dive curve table but only posted the link to that information that is contained on another web page. If there was an infringement it did not occur here but on the web page that was copied and pasted into this comment thread. The chart can be made so it can not be copied, and as long as it is copied for personal use and not personable gain or distibuted to others there would be no infringement.

Only 1 of these two examples could be considered copyright infringement.

The first has the needed material to support who's material they are supplying, which in this case is their own observations and researched materials.

But the 2nd could be considered copyright infringement due to the fact that they personally posted the raw numbers in a public forum atmosphere, and they did not supply a link to that information nor credits to the original author. They got that information from some where, the question is did they do the research themselves or did they just pass along material printed in a book, a book that requires purchasing and contains the material that was passed along in an open forum.

By posting a link, that posted link would then furnish information that would already be available on the internet. The contents of the posted link may or may not infringe on the copy right material referred to in that links subject matter. In the case of the link posted in this thread a dive chart for Reef Runner Lures!

Here are the two links and I would like to direct everyone's attention to the second post of the second link, take a good hard look at who posted this material in the 2nd reply of the 2nd link!!!!!!! LOL....uh huh.

Your first example shows they did they're own testing. The link that was posted here from the other site does not.

Your second link doesn't work...? Huh...

I'm not here to get in a pissing match with anyone.

It was just a heads up, since Mark Romanck is a friend of mine, and I know he doesn't take this lightly.

    Nothing more.

Wakina posted a second link that is no longer working, because I deleted it. Here's the reason....

He dug up a thread from back in 2000 where I had done the same thing as you guys are doing here. Posting dive curve info. I thought it was innocent enough too and was just trying to be helpful....like you.

when I was first starting to use Off Shore boards and became friends with Bruce DeShano and Mark Romanack, Mark noticed my posting and called me on it. Since he knew me, I got my hand slapped, but nothing more. He explained the copywrite and how I wasn't allowed to be "helpful" in that way. It's something I remember anytime I get the urge to be helpful with that kind of info.

I wasn't a mod back then, so I couldn't delete the posting in that thread that Wakina dug up. But, now I am, and I removed it, because it was the right thing to do. Not because Wakina called me out on it, but because it should never have been posted in the first place. I learned my lesson from Mark.

That's all this is about......I just don't want anyone to get in trouble.

for what it's worth....I'm tired..and, I get kind of crabby in my responses sometimes. I apologize for that.

Time for bed. Have a good night.
